These terms govern the use of the marketplace operated by The Collector’s Edit, which connects artists and collectors for the sale of artworks.

If you do not agree with these terms, you must not use the platform.

Platform Role

The Collector’s Edit operates as an online marketplace platform connecting artists and buyers.

The platform facilitates the listing, promotion, and sale of artworks, as well as the processing of payments related to transactions conducted through the platform.

The Collector’s Edit is not the creator or owner of the artworks, unless expressly stated.

Responsibility for the artwork remains with the artist.

User Eligibility

Users must be at least 18 years old, provide accurate information, and comply with all applicable laws and regulations.

The platform reserves the right to suspend accounts violating these rules.

Artist Listings

Artists may upload artwork listings, including images, descriptions, prices, and technical information relating to the artworks offered through the platform.

By submitting artwork listings, artists represent and warrant that they are the legal creators and/or rights holders of the artworks and that such artworks do not infringe any copyright, trademark, intellectual property rights, or other rights of third parties.

Payments

Payments are processed through third-party payment service providers. The Collector’s Edit may charge commissions, transaction fees, or other fees associated with transactions conducted through the platform. Applicable fees and payment terms will be communicated at the time of sale or prior to the completion of a transaction.

Limitation of Liability

To the maximum extent permitted by applicable law, The Collector’s Edit shall not be liable for disputes arising between artists and buyers, claims relating to the authenticity of artworks, delays in shipping or delivery, or loss of or damage to artworks occurring during transport.

The Collector’s Edit acts as an intermediary platform and does not assume responsibility for the actions, representations, or omissions of users of the platform.

Intellectual Property

All content made available on the platform, including but not limited to logos, branding, website design, text, graphics, and interface elements, is the property of The Collector’s Edit or its licensors and is protected by applicable intellectual property laws.

Copyright and other intellectual property rights relating to artworks remain the property of the respective artists unless otherwise agreed in writing.

Suspension and Termination

The Collector’s Edit reserves the right to remove listings, suspend accounts, or terminate access to the platform where copyright infringement, fraudulent activity, violations of applicable law, or breaches of these Terms are identified or reasonably suspected.

Governing Law

Unless otherwise required by applicable consumer protection legislation, these Terms shall be governed by and construed in accordance with the laws of Portugal.
Nothing in these Terms shall affect any mandatory rights granted to consumers under the laws of their country of residence.
